These Terms & Conditions (“Terms”) govern your use of pnmfencing.com (the “Site”) and any request for estimates,
scheduling, or services provided by PNM Fencing (“we,” “us,” “our”).
By using the Site, you agree to these Terms.

1) Website Use

  • You agree to use the Site for lawful purposes only.
  • You may not attempt to disrupt the Site, probe security, or misuse forms or contact methods.
  • We may update or discontinue parts of the Site at any time without notice.

2) Estimates, Proposals, and Scope

  • Any estimate provided via the Site, phone, or message is a non-binding approximation based on information available at the time.
    Final pricing may change after an on-site review, measurements, permitting requirements, material selection, site conditions, and scope confirmation.
  • Any work performed is governed by a separate written proposal, invoice, or service agreement (if provided). If there is a conflict between these Terms and a signed agreement,
    the signed agreement controls for that specific project.

3) Scheduling, Access, and Site Conditions

  • You are responsible for providing reasonable access to the work area and for identifying any known hazards, boundaries, easements, or underground conditions you are aware of.
  • If utilities must be marked, you agree to cooperate with utility-locating procedures as applicable.
    Unexpected underground obstacles or unsafe conditions may require schedule changes or additional costs.
  • Weather, supplier delays, permitting, inspections, and unforeseen site conditions may affect timelines. We do not guarantee completion dates unless agreed in writing.

4) Payments

  • Payment terms (including deposits, progress payments, and final payment) will be stated on your invoice or written proposal.
  • Past-due balances may be subject to reasonable collection efforts and fees where permitted by law.

5) Cancellations

  • If you cancel after materials are ordered or work is scheduled, you may be responsible for non-refundable costs (e.g., special-order materials, delivery fees, restocking fees, and labor scheduling impacts) to the extent permitted by law.

6) Warranties

  • Manufacturer warranties may apply to certain products/materials. Warranty details (if any) are provided by the manufacturer and may require registration or specific care/maintenance.
  • Unless a written workmanship warranty is provided for your project, services are provided “as is” and “as available” to the maximum extent permitted by law.

7) Intellectual Property

The Site content (text, logos, photos, graphics, and design) is owned by or licensed to PNM Fencing and is protected by applicable intellectual property laws.
You may not copy, reproduce, or redistribute Site materials without prior written permission, except for normal browsing and printing a single copy for personal use.

8) Third-Party Services and Links

The Site may include third-party tools (e.g., embedded widgets, chat, maps) or links to third-party websites.
We do not control third-party sites and are not responsible for their content, policies, or practices.

9) Disclaimers

  • The Site is provided for general information. We do not guarantee the accuracy, completeness, or availability of Site content.
  • We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.

10) Limitation of Liability

To the maximum extent permitted by law, PNM Fencing will not be liable for indirect, incidental, special, consequential, or punitive damages,
or for any loss of profits, revenue, data, or goodwill arising from or related to your use of the Site.
Our total liability for any claim related to the Site will not exceed $100.

11) Indemnification

You agree to indemnify and hold harmless PNM Fencing from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees)
arising out of your misuse of the Site or violation of these Terms.

12) Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.
Any disputes will be brought in courts located in New Jersey, unless otherwise required by law.

13) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent changes.
Your continued use of the Site after changes are posted means you accept the updated Terms.
